These terms govern each visit to froxeo.com and each order placed on it. An order placed is an acceptance of them. They are short by design: where a subject has a page of its own, the numbers live there, and these terms point at that page.
The seller is one New York company
The seller: Lisa Pasco Funy LLC, a New York limited liability company with EIN 99-4781769, whose registered office is 229 Cleveland Dr, Cheektowaga, NY 14215. It trades as Froxeo.
In these terms: "Froxeo" and "the shop" mean that company and no other; "you" means the person using the site or placing the order.
Merchant of record: Lisa Pasco Funy LLC, on every sale. Nobody else.
Buyers are adults ordering for a lawful purpose
Age: 18 or older. No exceptions.
Payment: a method the buyer is entitled to use.
Address: inside the area the Shipping Policy describes.
Accounts: the holder keeps the login secure, and an order placed through it is treated as the holder's order.
Today the shelves hold books, and the door behind them stays open
The catalog on the date above: printed books. Three shelves. Twenty-nine titles. The policies speak of books because books are what is for sale.
How it may grow: new titles and new shelves first; later, perhaps, other goods sold the same way: stock bought new from a supplier it can name, photographs of the real thing, the shipping and return figures the books already carry, and the one returns address.
The rule for anything listed: it is sold on these terms and these policies from its first day on the site, and where a policy says "book", it means the item ordered.
Before the range changes: the rewrite comes first, on the About page and in the policies. Nothing is added quietly.
Prices are in dollars, and a typo is not a contract
Currency: US dollars. Prices move over time; the one shown when the order goes in is the one charged.
Separate lines before confirmation: shipping and any sales tax, as the Payment Policy describes.
An obvious mispricing: does not bind Froxeo. The order is cancelled before dispatch, every dollar refunded, and the reason explained. You are equally free to decline the corrected price.
An order becomes a contract when the book ships
The confirmation email: a receipt. Not yet an acceptance.
The contract forms: when the warehouse dispatches the book and the dispatch email leaves.
Before that moment Froxeo may decline or cancel: for a title sold out at the wholesaler, for a price typo, for a payment the fraud screen rejects, or for an address beyond the delivery area. Whatever was charged comes back in full.
Payment is taken at once, and the order day is the day to change your mind
When: at the moment of ordering, with a card that Stripe processes or with PayPal, as the Payment Policy sets out.
Through 11:59 PM Eastern that same day: one email to contact@froxeo.com can cancel the order, put a new address on it, or move it to a different title.
After that: the order sits with the wholesaler, and any change becomes a return.
Delivery is promised as a window, and no duty ever follows the package
Governed by: the Shipping Policy, which is part of these terms: windows, costs, the delivery area, tracking, and late, damaged or missing packages.
Origin: inside the United States. No customs charge ever follows a Froxeo package.
The window: 4 to 8 business days, an estimate most packages meet and not a guaranteed date.
Returns follow the notice New York law asks the shop to post
Set out in: the Refund and Returns Policy, part of these terms and the notice required by section 218-a of the New York General Business Law.
In brief: a 30-day window from delivery, no restocking fee, and postage on the side that caused the return.
Covers and blurbs belong to publishers; the notes belong to Froxeo
Publishers' and authors' property: book covers, jacket copy, product images. All displayed here so the books they belong to can be sold.
Froxeo's property: the name, the bracket mark, the page layouts, and the note written under each title.
Allowed: reading the site and printing a page for personal use.
Not allowed without written permission: copying the site, scraping it, framing it, or reusing the Froxeo name, mark or notes commercially.
A copyright complaint gets a reply within a business day
Where to send it: contact@froxeo.com, subject line "Copyright complaint".
What it must contain: six things. The work said to be infringed; the page on froxeo.com where it appears; the complainant's name, postal address and email; a statement, in good faith, that no permission stands behind the use; a sworn statement that the notice is accurate and that the complainant owns the work or represents its owner; a physical or electronic signature.
What happens: an answer within 1 business day; material named in a complete notice is taken down during review; whoever posted it may answer with a counter-notice carrying the same details.
Reviews come only from buyers, and none is bought
Who may post: a customer who bought that title from Froxeo, which is why each review carries a verified-purchase label.
What Froxeo never does: pay for a review, offer anything for a favorable one, or remove one for being unfavorable.
What comes down: abuse, someone else's personal information, and reviews plainly about a different book.
Display: on the product page, with the reviewer's first name and last initial.
The standard: the FTC's Consumer Reviews Rule, which the shop keeps to.
Five things get a visitor barred from the site
One: using the site to break a law.
Two: paying with a stolen or unauthorized card or account.
Three: claiming a package never arrived when it did, or returning a book as unread when it was read.
Four: attacking, probing or overloading the site.
Five: posting a review someone paid for, or one about a purchase the poster never made.
Consequence: access to the site ends. Some of the five get reported.
No promise beyond the description, except the ones the law makes
What is promised about the site: nothing about uninterrupted or error-free running.
What is promised about a book: its title, edition, binding, page count and the note on its page, read alongside the Disclaimer.
Untouched: the warranties and remedies your state's consumer statutes give you, which no contract can strip away.
Froxeo's liability stops at the order
The ceiling: what was paid for the order, the books together with the shipping.
Outside it: indirect and consequential losses: a title bought elsewhere in a rush, time lost, a decision taken on the strength of a book's advice.
Where the law of your state refuses that ceiling: it yields there, and nowhere else.
New York law applies, Erie County courts decide, and thirty days of email come first
Law: the State of New York, with no regard to its rules on conflict of laws.
Before any formal step: 30 days of trying to settle by email, counted from the day one side describes the problem to the other.
Failing that: the state and federal courts in Erie County, New York, where each side agrees to appear.
Not required: arbitration. Not closed: small claims court. Not removed: anything your state's consumer statutes give you. Ever.
The date at the top says which version applies, and one clause can fall without the rest
A change: moves the date under the title and applies to orders placed after it.
An order already placed: keeps the terms it was placed under.
A change of substance: gets announced on the site. Quiet edits are not how this page works.
An unenforceable clause: shrinks to the narrowest form a court permits, and every other clause stands.
The whole agreement: these terms together with the policies they link to, replacing any earlier version.
Claims caused by a breach on your side: you bear the cost of a third party's claim against Froxeo to the extent your breach caused it.
